1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and DA EEO SERVICES ("we," "us," or "our"), concerning your access to and use of the daeeoservices.com website and any related courses, memberships, community features, or services (collectively, the "Services").

By accessing or using the Services, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of the Services immediately.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services. By using the Services, you represent that you meet this requirement.

4. Purchases and Payment

All courses, memberships, and products are offered for purchase through our Services, with payment processed via Stripe, PayPal, and/or Kajabi Payments, and may be paid using Visa, Mastercard, Discover, American Express, Apple Pay, or Google Pay.
By making a purchase, you represent that you are authorized to use the selected payment method.
All fees are listed in U.S. Dollars unless otherwise stated and are due at the time of purchase.
All sales are final.

5. Access to Courses and Membership Content

Upon purchase, you will be granted access to the applicable course or membership content through your Kajabi account.
You agree not to share, reproduce, distribute, or resell any course materials, videos, or content without our express written permission.
We reserve the right to revoke access to the Services for any user who violates these Terms.

6. Community and Communication Features

Our Services may include a community, discussion, or chat feature. By participating, you agree to:

Communicate respectfully with other users and moderators.
Not post content that is unlawful, harassing, defamatory, or infringing on the rights of others.
Understand that we may monitor, moderate, or remove content at our discretion.

We are not responsible for the content or conduct of other users within community features.

7. Intellectual Property Rights

All content provided through the Services, including but not limited to course materials, videos, text, graphics, logos, and other materials, is owned by or licensed to DA EEO SERVICES and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from this content without our prior written consent.

8. User Conduct

You agree not to:

Use the Services for any unlawful purpose.
Attempt to gain unauthorized access to any portion of the Services.
Upload viruses, malicious code, or engage in activity that disrupts the Services.
Impersonate any person or entity or misrepresent your affiliation.

9. Third-Party Services

Our Services integrate with third-party tools including Google Analytics, and payment processors (Stripe, Apple Pay, Google Pay, PayPal, Kajabi Payments). Your use of these integrated services may also be subject to those third parties’ own terms and privacy policies.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE ANY SPECIFIC RESULTS FROM THE USE OF OUR COURSES OR SERVICES.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL DA EEO SERVICES ITS OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE PERIOD GIVING RISE TO THE CLAIM.

12. Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

13. Dispute Resolution

Informal Negotiations. To expedite resolution and control the cost of any dispute, you and we agree to first attempt to negotiate any dispute informally for at least thirty (30) days before initiating arbitration.

Binding Arbitration. If informal negotiations do not resolve the dispute, it shall be resolved through binding arbitration conducted in the United States, rather than in court, except that either party may bring an individual claim in small claims court.

Governing Law. These Terms shall be governed by the laws of the State of Ohio, without regard to its conflict of law provisions.

14. Modifications to the Services and Terms

We reserve the right to modify these Terms or the Services at any time. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.

15. Termination

We reserve the right to suspend or terminate your access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business.
